不是我啥都明白,而是你啥都一知半解就瞎出主意呀。
- 你知道可以要回一半中介费,却不知道MOM不管中国中介。现在你不提要回中介费的事了吧。
- 你知道可以投诉,却不知道可能被要求留下协助调查。现在你也不建议投诉雇主勾结中介了吧。
- 你知道解除合同要提前通知,却不知道这个通知期有多长,想当然地认为雇主必须提前一个月通知。
看下面那行红字,工作不满26周的只需要提前一天通知就可以解除合同。
Termination of employmentWhat rights do employees have when their employment contract is terminated?
The Employment Act sets out very basic rights relating to termination, for employees covered under the Employment Act (see Question 2). The employment contract may and typically does set out other rights relating to termination.
Notice periods
An employer and its employee are free to agree on a notice period. However, if the employment contract does not provide for a notice period, and the employee is covered under the Employment Act, the employer must adhere to the minimum notice periods stipulated in the Employment Act. The minimum notice periods depend on the employee's length of service:
- Employed for less than 26 weeks: one day.
- Employed for 26 weeks or more but less than two years: one week.
- Employed for two years or more but less than five years: two weeks.
- Employed for five years or more: four weeks.
If the employment contract does not provide for a notice period, and if the employee is not covered under the Employment Act, the employer must provide reasonable notice of termination.
